Rules and guidance

This area includes the legal and administrative texts as well as general guidelines, adopted in Spain on the prudential regulation on Credit Institutions and Investment Firms. It is relevant to note that the adaptation to Directive 2013/36/EUAbre en nueva ventana and Regulation 575/2013/EUAbre en nueva ventana into the Spanish legal framework is a two stages process:

  • First, a Royal Decree-Law that adapted the Spanish regulation to those regulatory changes that were more urgent - Royal Decree-Law 14/2013Abre en nueva ventana - and that was followed by a Banco de España Circular (Circular 2/2014Abre en nueva ventana, de 31 de enero, del Banco de España, a las entidades de crédito, sobre el ejercicio de diversas opciones regulatorias contenidas en el Reglamento (UE) nº 575/2013, del Parlamento Europeo y del Consejo, de 26 de junio de 2013, sobre los requisitos prudenciales de las entidades de crédito y las empresas de inversión, y por el que se modifica el Reglamento (UE) nº 648/2012).
  • Second, a new Law that recasts and adjusts all national legislation related to credit institutions: Ley 10/2014Abre en nueva ventana, de 26 de junio, de ordenación, supervisión y solvencia de las entidades de crédito that has been developed by Real Decreto 84/2015Abre en nueva ventana, and followed by Circular del Banco de España 2/2016Abre en nueva ventana, de 2 de febrero
