Options and national discretions

Directive 2013/36/EUAbre en nueva ventana, Directive (EU) 2019/2034Abre en nueva ventana, Regulation 575/2013/EUAbre en nueva ventana and Regulation (EU) 2019/2033Abre en nueva ventana include a number of options and national discretions to be exercised either by the supervised institutions or by the national supervisory authorities. This area provides information on the exercise of such options and discretions by the Spanish supervisory authorities. To this end, the meaning of the most relevant terms used here is given:

  • "Option": the competent authorities shall select one of the alternatives included in Community legislation in order to comply with a given rule.
  • "Discretions" / "National discretions": the competent authorities may choose whether to apply or not a given rule.
  • "Mutual recognition": the competent authorities allow institutions under their jurisdiction to apply, in specific areas of national discretion, the treatment chosen by another Member State, within the scope of the solvency directives.
